General terms and conditions

These terms and conditions apply to all treatments, group sessions, courses, training, consultations, therapy and coaching trajectories of Van Helen Healing.

 

Entry

After you have indicated that you would like a session, I will send you a client registration form with questions. By filling in this form, you agree to the terms and conditions.

When you register in writing for a meeting organized by Van Helen Healing and have made the full payment or advance payment (in case of cash payment), you agree to the general terms and conditions.

Despite my sincere care and attention that I give during a consultation, it may not bring you what you expect or hope for. I enter into an obligation to perform and not an obligation to achieve a result, because the result depends on many factors. Of course I will do my upmost to relax and guide your body as far as possible so that the desired result is achieved.

 

1. Applicability of general terms and conditions

1.1 The general terms and conditions of Van Helen Healing apply to all verbal and written agreements with Van Helen Healing containing actions that have been agreed with it, unless expressly agreed otherwise.

1.2 In these general terms and conditions, the term 'client' is understood to mean: a natural person who enters into an agreement with Van Helen Healing. Agreement: the agreement that has been concluded between the client and Van Helen Healing regarding the treatment, guidance, advice in the broadest sense of the word.

 

2. Health/Liability

2.1 The counselling and treatments are solution- and result-oriented, without guaranteeing the solution and the result. Van Helen Healing is liable for direct or indirect damage or injury arising out of or in connection with the services provided by Van Helen Healing, therapy, inner healing sessions, meetings such as women's circles and the like and the other treatments and courses offered are not a substitute for medical or psychological treatment. I don't make medical diagnoses. So always consult a doctor in case of long-term physical or psychological complaints.

2.2 By registering, you declare that you agree to the fact that you are aware that the outward and return journey, as well as participation in a treatment, therapy or coaching trajectory, is entirely at your own risk.

2.3 Van Helen Healing is not liable for damage caused to property or body of the client by parking on or entering the site at Calle Trajano 5, Estepona (Cancelada), nor for the damage caused by entering the house, the hall and using the toilet.

Van Helen Healing is also not liable for damage to property or body of the client due to parking or entering the grounds of a hired location for various meetings/events, nor for the damage caused by entering the hired location and the associated garden and outbuildings themselves.

 

3. Confidentiality and duty of confidentiality

3.1 Van Helen Healing is obliged to maintain confidentiality of everything that has been discussed during or in the context of the sessions and trajectories, and treatments, unless there are suspicions of abuse, in which case Van Helen Healing is forced to engage third parties.

3.2 The client is obliged to maintain confidentiality towards third parties at all times if the client does not comply with this regarding the content of the services of Van Helen Healing, she will forfeit a compensation of € 5000 per incident.

 

4. Payment

4.1 Payment is made via the bank or in the case of cash payment, an advance payment must be made via the bank, unless otherwise agreed. When paying by bank, a payment term applies within 7 days of the invoice date. If a payment term is exceeded, Van Helen Healing will be forced to send a maximum of 2 payment reminders. If the amount has not been received after 7 days after the 1st payment reminder, a 2nd payment reminder will follow plus € 20 extra (administration) costs. If, after 7 days, the amount has not been received again, the claim will be handed over and all costs will be borne in full by the client in accordance with the law.

4.2 In the event of non-payment or late payment or non-proper or improper fulfilment of any obligation resting on the client, Van Helen Healing is entitled to cease further deliveries or to suspend the fulfilment of its obligations without prior notice of default, without prejudice to its right to compensation for all direct, indirect and consequential damage, including loss of profit, and without prejudice to all other rights to which it is entitled.

4.3 If the client does not comply with her obligations after a written reminder, or does not do so in a timely manner or properly, the agreement can be dissolved in whole or for the defective part by Van Helen Healing, without prejudice to its right to compensation for all (dissolution) damage.

 

5. Appointments, consultations

5.1 The client has been informed about the costs and method of the treatment(s) via the website/telephone/email.

5.2 The treatment consists of one or more consultations, each of which is preceded by a consultation.

5.3 The duration of an Inner Healing session is 2 to 2.5 hours during the first consultation, in connection with the discussion of the questionnaire. All subsequent sessions last a maximum of 1.5 hours. For every hour or half hour that follows, 15 euros per half hour and 30 euros per full hour will be charged on top of the agreed price per session. These hourly prices do not include VAT.

5.4 Under no circumstances does the client make use of video, recorders, etc.., without the explicit permission of the therapist.

5.5 The therapist makes a treatment plan in consultation with the client and enters into a relationship with each other for a certain period of time in the therapist-client relationship.

5.6 After each treatment, it will be decided in consultation whether the treatment will be continued.

 

6. Cancellation

6.1 Appointments must be cancelled no later than 24 hours before the start of the session, unless otherwise agreed in writing. The cancellation must be done by telephone and/or email or whatsapp with a clear mention of name, the date of the appointment and the telephone number. In case of non-cancellation or non-cancellation within 24 hours before the appointment, Van Helen Healing is entitled to charge the reserved time to the client.

6.2 The cancellation of the client's presence at a group session or meeting/event must be done in writing, clearly stating the name, date and telephone number. If the cancellation is 7 days before the event, the client will only lose his advance payment. When the cancellation has expired the 7 days before the event period, the client will lose his entire payment.

 

7. Intellectual property

7.1 All intellectual or industrial property rights to all books, course material, as well as preparatory material thereof developed or made available pursuant to the agreement (together referred to as: "information") are exclusively vested in Van Helen Healing.

7.2 It is not permitted to make the information available to third parties, to reproduce it, to copy it or to have it made, unless Van Helen Healing has granted written permission.

7.3 In the event that an assignment is carried out according to the subject, specifications or instructions, provided by or on behalf of the client, Van Helen Healing is guaranteed that the use thereof will not bring it into conflict with legal or other regulations or protective rights of third parties and Van Helen Healing is indemnified against all claims related to alleged infringements of intellectual or industrial property rights of third parties.

 

8. Supervision and children

8.1 Van Helen Healing is bound by the legal rule that for children under the age of 16, if applicable, both authoritative parents/guardians must agree to the guidance, by means of a signature on the agreement. The authoritative parent/guardian ensures that the partner with authority, if any, is informed about the guidance. Van Helen Healing cannot be held responsible for informing the authoritative partner.

 

9. VAT

9.1 The prices quoted include VAT.

 

10. Applicable law and competent court

10.1 All offers and agreements of Van Helen Healing are exclusively governed by Spanish law.

10.2 All disputes arising from or in connection with the offer, assignment, agreement or obligation with Van Helen Healing, will be settled in the first instance exclusively by the absolutely competent court in the district.

 

11. Personal data

11.1 Your contact details (such as name, e-mail, address, telephone number and social media accounts) as well as your other personal data are for me and for me alone and I will handle them discreetly. This is in accordance with the European General Data Protection Regulation (GDPR). I use the contact details to keep in touch with you about the path we are going on together as therapist and client of Van Helen Healing. I will only ask for your contact details after you have indicated that you want to work with me. If you decide against it after an orientation, that's no problem at all. Then any data you may have will disappear from my system.

 

Special provisions

If the therapist is unable to attend for more than 4 weeks and is unable to carry out the consultations, the treatment agreement ends.

If the client has any questions outside of the consultation, he/she can do so via e-mail/app/in writing, trying to answer the questions the same day.
